Pre & Post Nuptial Agreements

Making Decisions for the Future

The biggest issues in many marriages and divorces center around money and property. More and more often, couples are looking ahead and making prenuptial or postnuptial agreements that define and protect non-marital assets.

A prenuptial agreement or postnuptial agreement is a contract between two people. A pre nuptial agreement is drafted and signed before marriage, and a post nuptial agreement is drafted and signed during the marriage. The lawyers at Nangia & Kazansky in Brooklyn can answer your questions about prenuptial and postnuptial agreements.

  • Define and protect assets: In a New York divorce, equitable distribution of property is required. By making a contract in advance, the parties agree on what is a non-marital asset and what is a marital asset. Non-marital assets are not part of a divorce property settlement. The parties can also make a determination about spousal maintenance in the event of a divorce.
  • Legal counsel: Each party should be represented by his or her own lawyer. Your attorney can assure that the agreement is fair to you and that you understand all the terms of the agreement.

The attorneys at Nangia & Kazansky can help you determine whether you need a prenuptial agreement and what should be included in the agreement. Contact us — we represent clients in Brooklyn and throughout New York City.
